Gary McKinnon should not be extradited to the USA. He behaved stupidly, hacking into 97 US military computers. But he did no vandalism, created no viruses, did no harm apart from leaving some abusive messages.
Gary McKinnon suffers from Asperger's Syndrome, which exhibits itself in obsessive behaviour. He was foolish: but no good would be served by extraditing him to the USA where he would face up to 60 years in prison. Both common sense and compassion suggest that he should be treated leniently, in Britain.
His case has led to calls for our extradition treaties, with the USA and others, to be reviewed. There would be no harm in a review but in recent years they have operated well, seeing some unpleasant criminals being returned across the Atlantic in both directions. Both justice systems are better for having the option of extradition.
But it must be exercised with common sense and sensitivity. In the case of both were absent. The UK Director of Public Prosecutions decided not to prosecute him and the High Court should uphold that decision when it rules on it next month.
